Terms and Conditions of Use

1. General 

These Terms and Conditions of Use (hereinafter referred to as the « Terms of Use ») govern the download and use of the mobile application SmartCleaner (hereinafter, the « App »), owned by WayUp SAS, a company registered in France under the RCS of Meaux, with its headquarters located at Champs-Sur-Marne, France (hereinafter, « the Company, » « we, » « our, » or « us »). By downloading and/or using the App, you acknowledge that you have read and fully understand these Terms of Use and agree to comply with them. If you do not agree with any part of these Terms, please refrain from downloading or using the App. 

Changes to the Terms: The Company reserves the right to amend these Terms of Use at any time to comply with French regulations or adapt to business needs. Such modifications will take effect upon their publication within the App. Users are encouraged to review the Terms of Use regularly. 

The Company may suspend or block access to the App for users who violate these Terms. 

If any provision is found to be invalid or unenforceable by a court, the remaining provisions shall remain fully applicable. 

2. App Features 

The App provides smart cleaning tools designed to: 

• Free up storage space by removing duplicate, similar, or blurry content (photos, screenshots, videos); 
• Merge duplicate contacts or calendar events; 
• Optimize the organization of personal devices. 

Notes: 

• The App will request confirmation before deleting any content to prevent accidental deletions. 
• Certain features are available offline. 
• Feature updates may be released periodically.

3. Access and Use 

The App is compatible with iOS and Android devices. 

Conditions of Use: 

• You must be of legal age in your country of residence to use the App. ● Downloading the App and accessing certain basic features is free, such as a limited number of deletions per day. 
• Access to advanced features requires a paid subscription. 

By subscribing, you agree to the associated costs, recurring billing terms, and become a customer of the App. 

4. Premium Subscriptions and Payments 

Subscription Options: 

• Various subscription plans (weekly, monthly, annual) are available to suit user preferences. 

Payment Terms: 

• Payments are processed through your Apple/Google account. 
• Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. 

Refund Policy: 

• Refund requests must be addressed directly to Apple or Google. WayUp SAS will not process any refund requests. 

5. User Commitments 

By using the App, you agree to: 

• Not impersonate others; 
• Not use the App for illegal purposes; 
• Not tamper with, decompile, or reverse-engineer the App’s source code; ● Not infringe upon the intellectual property rights of WayUp SAS.

The Company reserves the right to block or suspend a user for any behavior that violates these Terms or applicable laws. 

6. Intellectual Property 

The App and its contents (texts, graphics, logos, trademarks, etc.) are the exclusive property of WayUp SAS and are protected by French intellectual property laws. 

7. Disclaimer of Liability 

WayUp SAS does not guarantee that the App will be error-free or available without interruption. The Company disclaims all liability for: 

• Improper use of the App; 
• Voluntary or accidental deletion of content by the user; 
• Damages caused to third parties due to the use of the App. 

8. Data Protection 

Your personal data is processed in accordance with our Privacy Policy, compliant with the GDPR and French data protection laws. 

9. Governing Law and Jurisdiction 

These Terms of Use are governed by French law. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Meaux, France. 

In the event of a dispute, mediation may be considered before initiating legal proceedings.
